What Are Bail Bonds and Who Can Get Them
A bail bond is a contract between a bail bonds agency, a defendant and a co-signer who can be financially responsible for the defendant. The 8th Amendment of the U.S. Constitution entitles every American citizen the right to post bail and be released from jail if they are arrested. A bail bond is a set amount of money that is required to be paid before a person can be released from jail after an arrest. Once the bail has been paid the defendant is released and they can resume their regular daily activities until they are required to return to court for their hearing.
Bail is set according to the severity of the crime. Minor offenses result in a minimum amount of bail, sometimes as little as $500 to $800. If the crime is of a violent nature, the judge fears for the defendant's safety or there is a reasonable belief that the defendant may flee their obligations, the judge may refuse to set bail at all and keep the defendant in custody. If bail is set, the defendant needs to higher a bail bonds agent and post at least 10 percent of the total bond amount to be released from jail although in some cases a discount of up to 30 percent off the 10 percent standard fee may apply to qualified clients.
If the defendant meets all of the requirements of the court and the case concludes, the bail will be exonerated and the fee will be released to the agency or the co-signer. If for some reason the defendant does not appear in court at their scheduled hearing, the bail money that was posted will be forfeited and the co-signer will be responsible for the entire bond amount.
